Honorary Council of the Constitutional Court Sacked Anwar Usman, Proven to Violate the Code of Ethics

Indonesian Honorary Panel of the Constitutional Court (MKMK) stated that the Chief Justice of the Constitutional Court Anwar Usman, who is also Gibran Rangkabuming Raka’s uncle, was found guilty of violating the code of ethics related to the judicial review decision number 90/PUU-XXI/2023 regarding the minimum age limit for presidential and vice presidential candidates.

“The reported judge is proven to have committed a serious violation of the code of ethics and behavior of constitutional judges as stated in Sapta Harsa Hutana, the principle of impartiality, the principle of integrity, the principle of competence and equality, the principle of independence, and the principle of appropriateness and decency,” said MKMK Chairman Jimly Asshiddiqie at the Constitutional Court building, Jakarta, Tuesday, November 7, 2023.

“Impose a sanction of dismissal from the position of Chairman of the Constitutional Court to the reported judge,” he continued.

MKMK ordered the Deputy Chairman of the Constitutional Court within 2×24 hours from the time the decision was read out to lead the organization of the election of a new leader by statutory regulations.

“The reported judge is not entitled to run for or be nominated as the leader of the Constitutional Court until the reported judge’s term of office as a constitutional judge ends,” Jimly Asshiddiqie said.

In addition, MKMK also prohibited Anwar Usman from being involved in making decisions on election cases.

“The reported judge is not allowed to be involved or involve himself in examining and making decisions in cases of disputes over the results of the presidential and vice presidential elections, elections of DPR, DPD and DPRD members, as well as elections of Governors, Regents, and Mayors which have the potential for conflicts of interest,” he added.

Previously, MKMK received 21 reports of alleged violations of the code of ethics and behavior of constitutional judges related to the decision on the minimum age limit for presidential and vice presidential candidates
